Should Law Schools Be Responsible for Students Pass Rates?

The ABA is considering a plan that would force all law schools to ensure that 75% of their students pass the bar exam within two years of graduation.

The US Department of Education is pressuring the ABA to hold law schools accountable for its students’ pass rate.  As we know, many law students leave law school with enormous debt they are unable to pay because the student cannot pass the bar exam.

The current ABA rule allows law schools to meet the bar passage requirement in two ways:  At least 75% of their graduates pass the bar exam during 3 or more of the past 5 years or the first-time bar pass rate is no more than 15% below the statewide average in at least 3 of the past 5 years.  This would jeopardize the accreditation of many schools

The MBE & UBE Testing Institute has  talked with deans from many law schools.  The deans are only focused on their current students and not those that have graduated and have struggled to pass the bar exam as repeat takers.
