New York’s Grim Reality for Repeat Takers

In honor of Halloween, here is about the most scary statistic I have seen for repeat takers in New York.

For repeat takers in New York,  the pass rate is dismal. For all students who took the New York bar exam as repeat takers, the pass rate for February 2015 was 35%, for July 2015, it was 22% and combined it was 29%.  Put another way,  4,632 repeat takers sat for the  combined 2015 bar exams and only 1,349 students passed.  A very gloomy statistic.

For NY ABA Law Schools: in February 2015, the repeat taker pass rate was 45%, in July 2015, it was 31% and combined was 39%.

For Out of State ABA Law Schools, the pass rate for repeat takers in February was 43%, in July 2015 it was 23% and for the combined year, it was 35%.

For All ABA Law Schools, the pass rate for repeat takers in February was 44%, in July 2015 it was 27% and for the combined year, it was 37%.

For Foreign Educated students, the pass rate for repeat takers in February was 24%, in July 2013 it was 17% and for the combined year, it was 20%.

Interestingly, the statistics seem to favor the repeat bar taker in February, rather than July.  Most repeat bar exam takers have the misimpression that February is a harder bar exam.

The Low Scores on The New York Bar Exam

The MBE Testing Institute has done a quick comparison of the scores from July 2015 and July 2014 for New York.  The scores dropped considerably – much like many other states.
The overall pass rate from July 2014 to July 2015 dropped by 4% points.  July 2014’s overall pass rate was 65% and July 2015’s overall pass rate was 61%.
The overall first time taker pass rate for July 2014 was 74%. In July 2015, the overall first time taker pass rate was only 70% - a drop of 4%.
Without the foreign educated attorneys, the first time taker rate was 83% in July 2014, but only 79% in July 2015.
The foreign educated pass rates stayed statistically the same.  In July 2014, the pass rate was 44% for first time takers and the overall pass rate was 34%.  In July 2015, the foreign educated attorneys pass rate was 42% for first time takers and 33% overall.
As we know, February 2016 will be the last New York exam – the UBE will take its place in July 2016.

The New York Bar Exam Statistics

The New York bar exam results for July 2015 are now out, as well as the statistics. New York had a  61% overall pass rate. For first time takers it is 70%, which includes foreign educated attorneys. 
Without the foreign educated attorneys, the first time taker pass rate is 79%.

The foreign educated attorneys pass rate is 42% for first time takers and 33% overall.
New York will post its public lookup on Wednesday.

Interestingly, the Board examined 10,671 candidates, which is the lowest number of candidates to sit for a July bar examination since 2006.  The number of graduates from American Bar Association accredited law schools who took the bar examination for the first time in July 2015 was 6,535, which is the lowest number since the July 2004 examination.

The Bar Exam Results for July 2015: The MBE Push Back

The MBE has pushed back again this year.

If you have read The MBE Testing Institute tweets and blogs, you know that the average score on the MBE on the July bar exam fell 1.6 points from the previous year, reaching its lowest level since 1988, according to data provided by the National Conference of Bar Examiners. The mean score on the July bar exam was 139.9, down from 141.5 in July 2014.

Of course, the NCBE doesn’t blame the test but the law students.  The pile-on has begun with deans and law professors all blaming the students that they created.  Fearing for their own jobs, the deans and law professors are saying that they’ve been admitting students with lower qualifications who then fail the bar exam. It seems like it’s a problem the law schools have created, however, it’s this author’s opinion that the teaching at law schools is the real culprit.

In speaking with students, they feel the test is harder because this is the first July when Civil Procedure has been tested in “mass” numbers.  The NCBE, however, disputes this assessment, saying that the students did poorly across the board in all 7 subjects.

Whatever created this problem, we do know that performance on the bar exam has continued to dip down to levels we have never seen and it appears that this is not an aberration, but a new realty.

Here are the changes in overall bar pass rate, from July 2014 over July 2015, for some of the states already reported.

Florida, -2 points (July 2014 – 71%; July 2015: 68.9%)
Kansas, -3 points (July 2014: 79%; July 2015: 76%)
Mississippi, -27 points (July 2014: 78%; July 2015: 51%)
Missouri, -1 point (July 2014: 85%; July 2015: 84%)
Montana, -2 points (July 2014: 64%; July 2015: 62%)
New Mexico, -12 points (July 2014: 84%; July 2015: 72%)
North Carolina, -4 points (July 2014: 71%; July 2015: 67%)
Oklahoma, -11 points (July 2014: 79%; July 2015: 68%)
Washington, -1 point (July 2014: 77%; July 2015: 76%)
West Virginia, -5 points (July 2014: 74%; July 2015: 69%)
Wisconsin, -10 points (July 2014: 75%; July 2015: 65%)

So far, one of the few states that have gone up,  Iowa, is now switching to the UBE starting in February.  A mere coincidence?  Perhaps not.

Why Repeat Bar Takers Don’t Pass…The Myths and Reality of Passing

Most law graduates are under the false impression that the more times you take a state bar exam the greater your changes are to passing.

In fact, it is just the opposite. The more times you sit for a state bar, you increase your chances of being unsuccessful.

The statistical proof is clear and convincing that repeat takers continuously do poorer on the bar exam than first time takers. Here are the hard facts in a few states that have already reported:

Pennsylvania’s overall pass rate for July 2015 was 72%.  The pass rate for 1st time takers was 78%, the pass rate for second time takers was 31% , third time taker pass rate was 28% and 4+ pass rate was 16%.

Colorado’s overall pass rate for July 2015 was 77%.  The pass rate for 1st time takers was 78% and repeat takers pass rate was 30%

Oregon’s overall pass rate for July 2015 was 60%. The first time taker pass rate was 68% and the repeat bar exam taker rate was 19%.


These statistical repeat taker numbers are a clear representation that repeat takers, on an average, only pass the bar exam at about a 30% rate. Obtaining an MBE Testing Institute’s bar exam tutor should be the number one goal for all repeat takers.

Nevada, Colorado, Louisiana, Arizona, Tennessee, Pennsylvania Bar Exam Results

Nevada and Colorado’s bar exam results were released yesterday.  Nevada's pass rate was 60%.  Colorado has released its statistics.  Colorado’s overall pass rate was 72%.  The first time taker pass rate was 77% and the repeat rate was 30%.  For the law schools:  The University of Colorado’s  first time pass rate was 89% and repeat taker pass rate was 71%.  The overall pass rate for the University of Colorado was 88%.  For The University of Denver: their first time pass rate was 81%, their repeat taker rate was only 14% and  their overall pass rate was 75%.

Louisiana:  October 9, 2015 after 9:00 am

Arizona:  October 9, 2015 at 4:30 pm

Tennessee:  October 9

The Bar Exam Results for July 2015: Nevada, Colorado, Louisiana, Arizona, Tennessee, Pennsylvania Bar and South Dakota Exam Results

Today and tomorrow are going to be busy days for bar exam results for July 2015. 

First, South Dakota has released its bar exam results.

For today:  Nevada and Colorado’s bar exam results will be released today.  Nevada will release its results at 3 pm and Colorado will release its bar exam results after 10:00 am.

For Friday, it is a flurry of state releases:

Louisiana:  October 9, 2015 after 9:00 am
Arizona:  October 9, 2015 at 4:30 pm
Tennessee:  October 9
Pennsylvania:  October 9th

Repeat Florida Bar Exam Takers: What Does Your Score Really Mean

As you know, taking the Florida bar exam will be a challenging experience for all repeat bar exam takers. However, you must review and understand the breakdown of your scores. There are some important indicators as it relates to your July 2015 bar exam scores.

Let’s first start with the MBE. If you made below a scaled score of 125, that’s a clear indication that you lack the requisite knowledge of the subject matter, that you do not understand the methodology of the MBE and that you are not reading critically to obtain the proper factual analysis. You will not be able to score any higher on the MBE on your next bar exam if you do not get help. In light of this, you should retain an MBE Testing Institute’s Florida bar tutor. Learn how to avoid 0s and 1s on your North Carolina Essays – Attend Our Raleigh Seminar

We have been talking with students for weeks about the North Carolina bar exam.  More specifically, the students cannot believe that they end up with 0s and 1s on their bar exam essays.  Every student we’ve talked to claims that they knew the issues, but still ended up with no points or even a lousy 1 point.

Remember that North Carolina has a 10 point grading system and a  5 or 6 is considered an average score.  So, as we see, there is no room for error. If you end up with even one essay with an 0 or 1, you are probably not going to pass the North Carolina bar exam.  You must score average or above.

The MBE Testing Institute is holding an all day North Carolina group workshop on October 24th in Raleigh.  For the essay portion of the seminar, we will teach you specific techniques that will impact greatly on your essays, such as line by line analysis, timing, understanding the status of the parties, the importance of the call of the question and factual analysis. For the MBE portion, we will discuss and cover the frequently tested areas, areas always covered in each subject, understanding legal distinctions and narrowing your choices down to two answers.  The materials include MBE outlines and questions, essay strategies and analysis for frequently tested subjects.

Repeat Florida Bar Exam Takers: A Structured Plan for Success

Florida repeat bar exam takers should be very concerned with their ability to pass the Florida Bar Exam for a second, third or multiple times.

As we have shown through our blog, the repeat bar exam taker numbers are substantially lower than first time takers. Absent a very structured study bar exam plan, many of the repeat bar exam takers will repeatedly fail the bar until they just give up on their dream of becoming a lawyer. As a law professor, I know too many students in this heart-breaking category. They are devastated with their failure beyond comprehension. They are literally paralyzed with indecision, depression and uncertainty about their career and, more importantly, they question their own ability to pass the bar.

My advice is to start with a very intensive structured plan. Obtain an MBE Testing Institute’s Florida bar exam tutor and, more importantly, believe you will pass. Above all else, do not prepare for the exam as you did the first time. You have to change your approach with a structured plan for success.

The July 2015 Bar Exam Results: State Release Dates for October

Vermont has released its bar exam results yesterday – a low 52.4% pass rate.  Maine has also released their bar exam results. Next up, Connecticut on Friday.

Nearly half of the states come out in October.  Here are the scheduled July 2015 bar exam release dates for October:

Connecticut:  October 2, 2015
Delaware:  Usually comes out in early October
South Dakota:  Usually comes out in early October
Minnesota:   October 5, 2015
Nevada:   October 8, 2015 at 3:00 pm
Colorado:  October 8, 2015 after 10:00 am
Louisiana:  October 9, 2015 after 9:00 am
Arizona:  October 9, 2015 at 4:30 pm
Tennessee:  early October – last year it was Oct 10th
Illinois:  First two Weeks of October
Hawaii:  Usually first two weeks of October
Pennsylvania:  Mid-October
Alaska:  Approx.  Oct. 26
South Carolina:  Usually late October
New Hampshire:  Usually  mid to late October
DC:   Approx.  last Two Weeks of October
Georgia:   Approx.  late October; last year it was Oct. 24th
Virginia:  October 30, 2015
Ohio:  October 30, 2015
New York:  Usually last week of October or first week of November; last year it was October 28th
Maryland:  End of October; last year it was Oct. 31st.
