we’ve been asked more frequently is “what should I do if I was unsuccessful on
the Florida Bar Exam?” First, let the shock of failing the bar subside with a
few days of reflection. Clearly, this may be one of your greatest
disappointments, but don’t let it control or define who you are. You can pass
the bar exam in July 2017. Get right back up and say, “I will pass in July 2017.”
Do not repeat the same class,
study plan or approach you used the last time. It did not work. Coming close on
the bar is good only in horse shoes. One size does not fit all. Hard work and
having a study plan and study strategy will pay off. Say to yourself, “I will
be a lawyer.”

For February 2017, the pass
rate was 57.7%. This number is not
reflective of repeat takers. In fact,
the repeat takers pass rate was much, much lower. Unfortunately, Florida statistics do not
include repeat takers, but we know, from states who do publish those
statistics, the repeat bar exam taker rate is abysmal. As an example, yesterday, Missouri released
its statistics and for those repeat takers who took the bar 3 or more times,
the pass rate was only 32%, down 40% points from first time taker pass rate. In Pennsylvania, the first time taker pass rate
was 72%, 2nd time: 53%, 3rd time: 25%, 4 or more times, 23%. We can see that the pass rate drops for each
successive time a taker fails the bar exam.
Also, we can see that the
average MBE scores goes dramatically down for repeat takers. Let’s take a look at the Missouri
statistics. The average MBE score for
1st time takers was 137, For 2nd time takers, the MBE score was 128.5, and for 3 or more
takers, the score was 123.5. As we know, every point counts in the MBE and
in passing the bar exam.
Since Florida’s pass rate was
only 57.7%, we can extrapolate the repeat bar taker pass rate and it is too
horrible to contemplate. Why risk this
result again? Ask yourself where you would be if you failed again in July?

The mean scaled score on the
February administration of the MBE fell to 134, down a full percentage point
from February 2016, which fell 1.2 points from February 2015, which was 136.2.
February 2017’s MBE score was
the lowest average score on a February bar exam. The mean score has rapidly
dropped since 2014. The NCBE believes the downward trend is likely to continue.
July MBE scores have also
fallen.
As we know, repeat takers
desperately need any point they can muster.
A full percentage point down from last year means low bar exam scores
and that means that more repeat takers will fail the bar exam.

Yesterday, the Florida bar
exam results came out and, as we know, it was the lowest pass rate in recent
memory. For February 2017, the pass rate for first time takers was 57.7%, for
February 2016, the pass rate for first time taker was 58.4%. For February 2015, the pass rate was 64% and in February 2014,
the pass rate was 71.8%. These statistics only reflect first time takers. The repeat taker pass rate was shockingly
much lower.
We have never seen the pass
rate of law schools like we saw yesterday. Out of 11 schools, 6 schools were below
the state average. Florida Coastal was
25% and St. Thomas was 44.7%, an outrageously low pass rate. The non-Florida law schools were 41%.
Why were the scores so low?
There is a combination of
reasons. First, the MBE. We have seen changes in the last couple of
bar exam cycles that have caused the mean average to now drop to 134 nationwide. With Florida’s standard to pass the MBE at
136, it is extremely hard to get that magical 136 when the mean average is just
134. It makes the repeat bar exam
taker’s task almost impossible without help from a MBE & UBE Testing
Institute Tutor. Secondly, let’s look at
the Florida section of the bar exam.
