Performance of law graduates taking the bar exam in
February has hit the lowest point in more than a decade. The average score on
February’s Multistate Bar Exam was 1.3 points lower from last year to 132.7. That’s the
lowest average in more than 10 years, and marks the fourth straight year that
the February average declined. Most experts say the decline is because of the
repeat takers. 70% of those who sat for the bar in February had
already taken the test at least once and repeat takers on average perform worse
than those in their first sitting. The average MBE score for first-time takers
in February was 135, compared to 132 for repeat test takers. Repeat takers average score fell 1.7 points from
2017.The repeaters’ performance dropped
from last year, affecting the mean, February bar exam results are taking shape and the
repeat taker fail rate is shocking.North Carolina’s pass rate was 33%, with 80% of the repeat takers
failing, Mississippi’s pass rate was 36%, Massachusetts pass rate was 36.2%,
with 82% of the repeat takers failing. Ohio’s pass rate was 52%, New York’s
pass rate was 38%, with 75% of the repeat takers failing. Alabama’s pass rate
was 32.5%, with 85% of repeat takers failing. Pennsylvania’s pass rate was 52%,
with over 60% of the repeat takers failing, Missouri’s pass rate was 63%, with
66% of the repeat takers failing. The repeat takers pass rates do not bode well for
the jurisdictions that haven’t yet released scores, like Washington, DC,
Arizona, Nevada, Texas, California. Nevertheless, there is one inescapable conclusion –

ever given.Effective July 2018, Massachusetts

The New York bar exam results for February 2018 have
been released. Interestingly, this bar
exam had the lowest number of candidates examined in February since 2009. The passing rate for first time takers from ABA accredited
schools was 69%, a 2% decrease from last year.The overall pass rate for all ABA grads was 45%. For the foreign
educated first time taker rate, the passing rate was 42% and its overall pass
rate was 28%, a decrease of 6% from last year.The overall pass rate, which includes all candidates was 38%, this is 6%
lower than last year. Of the repeaters who took the bar, the pass rate was

The North Carolina February 2018 bar exam results
indicated that 70% of “all” bar applicants failed the bar exam with 80% of all repeat
takers failing the bar exam. Charlotte Law School, which includes “all” bar
takers, showed 91% of the school’s bar takers failed.All first time takers failed. Campbell’s pass rate was 38%, NCCU’s pass rate was
28%, UNC’s pass rate was 46%, Wake Forest’s pass rate was 33%, Elon’s pass rate
was 35% These statistics are alarming, shocking and unacceptable. These facts point out overwhelmingly that these law
schools are obligated to do better. As we know, July’s North Carolina’s bar

Yesterday, the Florida bar exam results came out
and, as we know, it was one of the lowest pass rate in recent memory. Yesterday,
the pass rate for first time takers was 57.9%, for February 2017, the pass rate
for first time takers was 57.7%, for February 2016, the pass rate for first
time taker was 58.4%.For February
2015,the pass rate was 64% and in
February 2014, the pass rate was 71.8%. These statistics only reflect first time
takers.The repeat taker pass rate was
shockingly much lower. We have never seen the pass rate of law schools like
we saw yesterday. Out of 11 schools, 7 schools were below the state
average.University of Florida was 32% and Florida A&M was 36.7%, an
outrageously low pass rate.The
non-Florida law schools (and we’re looking at Cooley in the mix) were 37%.
Why were the scores so
low? There is a combination of reasons.First, the MBE.We have seen changes in the last couple of
bar exam cycles that have caused the mean average to now drop to 132.7
nationwide.With Florida’s standard to
pass the MBE at 136, it is extremely hard to get that magical 136 when the mean
average is just 132.7.It makes the
repeat bar exam taker’s task almost impossible without help from an MBE &

It’s a horror story:February 2018’s MBE score was the lowest average score on a February bar
exam. The mean score has rapidly dropped since 2014. The NCBE believes the
downward trend is likely to continue. The mean scaled score on the February administration
of the MBE fell to 132.7, down 1.3% from last year. Every February the mean score has fallen by at

Tennessee released its bar exam results for February
2018.Overall, Tennessee had only a
35.6% pass rate.First time takers
passed at only a 60.2% pass rate and the repeat pass rate was only a 23.4%.In addition, the statistics show that the
mean scaled MBE was only 131.86.63.7%
of the takers were below 135 and nearly half, 46.2% were below 130.By school, the overall pass rate for Belmont
was 42.8%, Duncan had a 20% overall pass rate, Nashville had an overall pass
rate of 13.8%, Univ of Memphis had an overall pass rate of 58.3%, Univ of Tennessee
had an overall pass rate of 45%, Vanderbilt had a 100% pass rate and all other
law schools had a 40.3% overall pass rate. We have a number of states releasing their bar exam

As we wait for the states to release its bar exam
results, there is good news from the ABA as to passing rates. Recently, the ABA has released both first time and
ultimate outcomes for bar exam pass rate for every ABA accredited law school. The data shows that the majority of law graduates
who take the bar exam pass within two years, even at a time when state pass
rates have been trending down. Unaccredited schools were not counted and, as we
know, unaccredited schools have a horrendously low bar pass rate. According to the ABA, nearly 88% of 2015 law grads
who took the bar passed within two years. Additionally, 77% of the 2017 law
grads who took the bar passed on their first try, as did 74% of 2016 grads
nationwide. The

Illinois has released its bar exam results, making Illinois
