 Everyone sitting for the October 5th and 6th bar exam are warriors. You have withstood Covid,  bar exam delays, rescheduled bar exams (multiple times), made to take the exam remotely, required to understand the new exam format, have had problems with examsoft (and hoping that it actually works on exam day).  Everyone of us watching this struggle admires your fortitude. 

Despite all of the obstacles in your way, your goal for this last days is to keep your focus while you solidify your knowledge of the black letter law and improve your timing. The days before the exam is a time when you should be cool, collected and confident.

Don’t let anyone or anything distract you these days. It’s not worth it. You only have a few days left to go and you can relax later,

Remember to take care of your body and mind. This means eating well, getting some sleep and working on self-confidence.

As to practical things, make sure you have your examsoft working right, that you have the materials you need or are allowed, make sure you have your id handy, make sure your friends, family and pets know you need complete silence, etc.

Now that you know the law, make sure your timing is correct in light of the new format.

It isn’t uncommon to start running out of energy this week. So take some breaks to energize yourself. You need to keep your mind focused on bar material. Your focus is critical to success. Good luck in these last few days.

The California Bar OKs Temporary 2 Year Law Licenses in Place of Bar Exam

 The California State Bar’s Board of Trustees approved a plan that would grant temporary licenses to recent law school grads for less than two years.

The provisional licensing program, which had been ordered by the California Supreme Court, will serve as a stop-gap measure for law school graduates who haven’t yet passed a bar exam but wish to practice until the program ends in June of 2022. To remain licensed, participants will need to pass the bar once the program ends.

The state’s high court on Wednesday rejected a petition for diploma privilege, which would have allowed lawyers to be fully licensed without ever taking the exam.

Applicants for California’s provisional license program must be 2020 graduates of California law schools or of schools outside the state, if such graduates are permitted to sit for the bar exam under California law. There are no limits on the number of times an applicant may have taken and not passed the bar exam.

Participants must also be employed by, or have an offer from, an employer with an office located in California, and they also must agree to practice under a supervising lawyer who is an active licensee in good standing of the State Bar.

They must refer to themselves as “provisionally licensed” lawyers when in conversations with clients or potential clients, and in court pleadings. They may “not describe themselves as a fully-licensed lawyer, or imply in any way orally or in writing that they are a fully-licensed lawyer,” the board of trustees said.

Washington, DC Will Allow Limited Diploma Privilege to 2019 and 2020 Graduates Amid Pandemic

Washington, D.C.'s highest court ruled Thursday it will allow certain recent law school graduates to obtain a D.C. bar license and begin practicing law without taking or passing an exam due to widespread disruptions caused by the COVID-19 pandemic.

The D.C. Court of Appeals' 4-3 order makes the district the fifth jurisdiction — behind Utah, Washington, Oregon and Louisiana — to grant diploma privilege. The online-only bar exam in D.C. is still set for Oct. 5-6.

"The court therefore has determined, on a one-time basis, to permit certain recent law school graduates to be admitted to the D.C. Bar without taking or passing a bar examination, under a number of conditions intended to safeguard the public's interest in the competence and good character of those who are permitted to practice law in the District of Columbia," the order said.

The waiver program applies to 2019 and 2020 graduates from American Bar Association-accredited law schools who already signed up to take the D.C. exam next month or next year, the order said.

Some of the conditions laid out in the order include that applicants can't already be admitted to a bar in a different jurisdiction or have failed a bar exam. Applicants must also be certified by the dean of the law school they graduated from as being of good character and competent legal ability, and they have to practice in the district for three years after admission under the direct supervision of an enrolled, active member of the D.C. Bar.

Texas Will Be a UBE Bar Exam State In February 2021 – the MBE & UBE Testing Institute Can Help You Pass the First UBE Exam in Texas

Texas is about to complete its last Texas bar exam on October 5th and 6th. Effective for the February 2021 bar exam, Texas will administer the full UBE. 

Not only that, but Texas has set the passing score at a high 270.

The Uniform Bar Examination (UBE) is coordinated by NCBE and is composed of six 30-minute Multistate Essays (MEE), two Multistate Performance Test (MPT) tasks, and the Multistate Bar Examination (MBE). It is uniformly administered, graded, and scored and results in a portable score that can be transferred to other UBE jurisdictions. 

The UBE is administered over two days, with the MBE given on the last Wednesday of February and July and the MEE and MPT given on the Tuesday prior to that. Jurisdictions that use the UBE may also require applicants to complete a jurisdiction-specific law component.
