No Room At the Bar Exam Sites: Repeat Bar Exam Takers Cannot Take the Bar Exam in Some Jurisdictions



In light of the current Covid crisis, several jurisdictions are giving priority to only first time bar exam takers and not allowing repeat takers or foreign educated to sit for the bar exam.  


New York is one of these jurisdictions, allowing first time takers from New York law schools priority.  Washington, DC has announced yesterday it was giving priority to first time takers. Maine has already announced that it has reached capacity and will not accept any more applications. Massachusetts is making plans for limited seating capacity.

It’s astonishing to realize that over 60% of the bar exam takers are repeat takers in almost every state. In Massachusetts, the repeat takers made up 70% of the applicants. In New York it’s close to 64%.  In New York, the foreign educated applicants make up 44%, most of them repeat takers.

This translates to thousands of repeat takers not able to take the bar exam this bar cycle. Repeat takes and foreign educated applicants will be forced to wait until February to take the bar exam, but only if nothing else changes and, in these unpredictable times, February may also have seat limitations. Clearly, repeat takers are treated differently and we cannot predict other decisions that may affect them.

While repeat takers are adversely affected by this decision, this should be a motivating factor for starting bar preparation earlier, rather than later.  Be ready to pass your bar exam, no matter when you take it.

New York Say No and Not Here to Out of State Law Grads, Repeat Takers and Foreign Educated Lawyers

New York has said no to anyone but first time takers from New York law schools in sitting for the September 9th bar exam.  Since they will have limited seating capacity, NY Bole will only accept applications from any J.D. or LL.M. candidate who is sitting for the bar examination for the first time and who has graduated from one of the fifteen law schools located in New York State until May 15th. Bole will then assess available seating in light of existing health and safety guidance. If seating remains available, the Board will then open the application period to a larger pool of candidates.

The NY Bole has urged candidates to consider sitting for the UBE at a later date or in other jurisdictions.  Right now, there are only a very few jurisdictions whose registration is still open. 

Will New Hampshire, to name one, be inundated with applications before May 15th?
In addition, it looks like the 15 law schools will help administer the UBE exam at their law schools and offered their facilities to accommodate test-takers. It’s apparent that there will not be much space left after the first time takers get their seats.

Further, as we saw in the February 2020 bar exam and the July 2019 bar exam, over 60% of the takers in New York are repeat takers.  It appears that New York will not accommodate them. Nor will they accommodate the many foreign educated lawyers who fly to New York to sit for the bar exam. Not to mention, the first time takers from Harvard, Yale, Duke, etc who have good jobs lined up in New York.  This is untenable.

There must be a way to accommodate the first time takers outside of New York, the repeat takers and the foreign educated lawyers. As we know, the NCBE has announced plans for two testing dates:  September 9th – 10th and September 30th – October 1st.  With the large number of takers who usually sit for the July bar exam in New York, why doesn’t New York administer the exam on both testing dates to accommodate another batch of takers? If BOLE would be open to out-of-state hosting, this could add more takers. 

NY Bole needs to be more flexible and more creative to allow for all the test takers to be able to take the exam in New York in a safe, healthy and productive way.

Buckle Up, It’s Going to Be a Bumpy Ride: California Bar Exam Results Will Be Released in 1 Week

Last February, the California’s bar exam pass rate sank to just 31.4%.  75% of those applicants sitting for the bar exam were repeat takers. The passing rate for first-time applicants was 41% overall, the passing rate for repeat applicants was 28% overall.  The repeat failure rate was shockingly high.

We have seen some shocking low bar exam pass rates this February and the February 2020’s MBE mean score of 132.58 was one of the lowest average score on a February bar exam.

This does not bode well for California bar exam takers, especially for California repeat takers.

Nevertheless, there is one inescapable conclusion – you must pass the bar exam. Massachusetts Bar Exam Results Were Shockingly Low and Shows that Repeat Takers Need The MBE & UBE Testing Institute's Help

Massachusetts results were released this week. The passing statistics coming out of Massachusetts were shocking and appalling.

70% of the takers were repeat takers, a record high number of repeat takers. That is an outrageous number, even for February.  Only 30% of the takers were first time takers. It’s an amazing statistic to think that it’s now acceptable that most of the bar exam takers have failed the bar at least one time previously. It has become the new norm. But it doesn’t have to be tolerated.

Retaking the bar exam is unacceptable, because it delays your ability to work, it adversely affects you getting a job, it costs you money to continue to take the bar and it puts your career on hold. The MBE & UBE Testing Institute is here to help the repeat taker pass the bar exam.

Let’s look at some more statistics coming out of Massachusetts. The 70% repeat taker’s performance accounts for a shocking low overall pass rate of 37%. But the first time taker pass rate wasn’t much better. The first time taker pass rate was 54%.  The 2nd time repeat taker pass rate was only 38%, the 3rd time taker pass rate was 31%, the 4th time taker pass rate was 21% and the 5th time plus repeat taker pass rate was 11%.  As we can see and unlike the law school myths, the more you take it, the less likely you will eventually pass without intervention and Bar Professors’ help.

Let’s look at the dreadful law school overall pass rates.

Boston College:  56.3%
Boston University:  68.8%
Harvard:  100%
Massachusetts School of Law:  25.3%
New England Law:  29.4%
Northeastern:  39%
Suffolk:  34.3%
University of Massachusetts at Dartmouth:  46.2%
Western New England:  25%
All Other Schools:  41.6%

Of 10 law schools, 7 law schools pass rates were below 50%.  These statistics are alarming, shocking and deplorable. These facts point out overwhelmingly that these law schools are obligated to do better.

California Postpones its Bar Exam to Sept 9th and Looks to Online Testing

The Supreme Court of California on Monday ordered the July California Bar Exam be postponed to Sept. 9-10, and directed the State Bar to make every effort to administer the test online with remote or electronic proctoring. 

The State Bar of California should also allow those registered to withdraw with a full refund through the day before the exam, Sept. 8.

Exam results should be disclosed to takers no later than Dec. 31.

Among the other measures approved by the court:

Work with the National Conference of Bar Examiners to facilitate online administration of the multiple-choice part of the test—the 2020 Multistate Bar Examination (MBE), or some variation of it—in September.

Submit a workplan to the court no later than May 11, with planned goals and milestones for online administration of the tests.

The National Conference of Bar Examiners, which provides the Multistate Bar Examination, will formally announce its plans for administering its exams, including exam dates, on May 5. The organization has begun initial planning to offer the exam Sept. 9-10.

One of two scenarios presented to the Supreme Court by the California Bar’s Board of Trustees was the development of a provisional certification program, under which those eligible would be certified to work under the supervision of a licensed California attorney.

The court indicated that it will continue to explore that and other options as circumstances related to the COVID-19 pandemic develop or change.

In addition to the issues of the bar exam, California will also make changes to the First-Year Law Students’ Examination (the Baby Bar) with online administration and postponement of the test.
