Washington Is the Second State to Adopt a Diploma Privilege. Is the NCBE Worried that Other States Will Follow?

Washington state has become the second jurisdiction to adopt an emergency diploma privilege amid the COVID pandemic, allowing law graduates from an ABA accredited law school & are currently registered in Washington to skip the bar exam, including repeat takers. The exam will be held in July & September for those who do not qualify. It's a "temporary" order, so next year's prospective bar members would still have to take the bar; but it looks like anyone who qualifies this year will get permanent Washington bar membership status. This sort of "diploma privilege" had also long been available in Wisconsin, but only to graduates of the Wisconsin law schools (University of Wisconsin and Marquette); this is open to graduates of all ABA-accredited law schools. In addition, Utah has also granted a diploma privilege with qualified candidates who have submitted an application to take the Utah bar exam on or before April 1, 2020; must have graduated from a law school with an overall first-time passage rater of 86% or greater in 2019.

There are 6 weeks until the July bar exam. Where should you be today?

Follow Your Schedule

By this time you should have set a realistic work schedule that allows for lecture time, review time, practice time and relaxation time.

Maintain your concentration level by varying your study activities, i.e. if you are reading an outline and losing focus, start practicing questions.

Know Your Law

You should be trying to commit to memory the black letter law.

Knowing the law means that you internalize the material in such a way that you truly “own” it and can spit it out on demand. This does not mean that you recognize the material or it seems familiar to you. The bar exam requires you to know the rules with precision and specificity and to have a solid understanding of the rules.

Continue to do practice questions, essays and performance tests.

Know Your State Bar Exam

You should know your bar exam like the back of your hand. Everyone must prepare for the MBE, but you should know the ins and outs of your state exam. Tailor your studies to your state exam.

California’s Bar Exam Will Be Either in September or October After a Abysmal 28% Pass Rate for February

California will hold its rescheduled bar exam on September 9th and 10th or it may be pushed back to October. California is still looking for options to hold the bar exam, including looking into online options.

No matter how California will hold its bar exam, we all know that the pass rate is abysmal. The pass rate for February was 28%, one of the lowest pass rates in history. The passing rate for first-time applicants was 38% overall. The passing rate for repeat applicants was 22% overall.

Massachusetts Bar Exam Will Be on September 30th After a Shockingly Low 37% Pass Rate for February

Massachusetts will hold its rescheduled bar exam on September 30th and October 1st, along with Maine, Rhode Island, Connecticut, Utah, the Virgin Islands, Kentucky, Tennessee, and, maybe, Colorado.

For repeat takers taking the Massachusetts/UBE bar exam you should start preparing. The pass rate for Massachusetts in February was a shocking 37% overall pass rate. 70% of the takers were repeat takers, a record high number of repeat takers. The first time taker pass rate was 54%.  The 2nd time repeat taker pass rate was only 38%, the 3rd time taker pass rate was 31%, the 4th time taker pass rate was 21% and the 5th time plus repeat taker pass rate was 11%.  As we can see and unlike the law school myths, the more you take it, the less likely you will eventually pass without intervention and Bar Professors’ help.

Washington, DC Bar Exam To Go Online in October After a 38.7% Pass Rate for February

The District of Columbia’s next bar exam will be a pared-down, online-only test administered October 5th and 6th, because both Covid-19 and the overwhelming demand for seats made an in-person test increasingly untenable. The exam will be open to anyone qualified under D.C. Court of Appeals rules, including repeat test-takers.

D.C. will join Michigan, Indiana, Nevada in offering the bar exam online.

For repeat takers taking the October 2020 DC/UBE bar exam you should start preparing. The repeat taker pass rates have declined dramatically in February.  The pass rate for DC in February was a shocking 38.7% overall pass rate. We know that the repeat bar exam taker was much, much lower. Even if the DC bar exam is online, you still need to enroll in the MBE & UBE Testing Institute extended bar exam program. This online bar exam may be you best chance to pass the DC/UBE bar exam and we can help you do so.
